Platfone – Terms of Use

Welcome to Platfone, operated by Privatix LTD. These Terms of Use (“Terms”) form a legally binding agreement between you (“User”) and Privatix LTD, governing your access to and use of platfone.com, its APIs, dashboards, mobile apps, and related services (collectively, the “Platform”). By using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, please stop using the Platform.

1. Introduction and Acceptance

Platfone is operated by Privatix LTD. All contractual relationships, obligations, payments, compliance, and support are handled exclusively by Privatix LTD.

These Terms apply globally and are governed by the laws of Privatix LTD’s place of registration. Payments processed by TempLabs LLC or other entities do not change the governing law or contracting party.

2. Definitions

Platform
– the complete Platfone ecosystem, including platfone.com, APIs, dashboards, SDKs, and mobile/web apps.
Credits
 – prepaid balance used for activations.
Activation
 – use of a number to receive an SMS or verification call.
Report
 – a user-submitted claim regarding a defective activation.
Partner
 – resellers, affiliates, or white-label operators integrating the Platform.
User Account
 – a registered account tied to email or social login.
Privatix LTD
 – the legal operator of Platfone.
KYC
 – identity verification performed via 3rd party provider.

3. Nature of the Service

Platfone provides software infrastructure and programmatic tools that enable users to access mobile numbers for receiving messages from third-party services. The Platform functions exclusively as a technical intermediary and data-routing service, not as a telecommunications operator or carrier.

All communications are processed through trusted supplier networks. Platfone does not own or lease phone numbers from any national numbering plan. Numbers are shared, automatically recycled, and never permanently assigned to any user.

The Platform is provided solely for lawful purposes, including account verification, software testing, privacy protection, and business purposes.

4. Account Registration and Access

Accounts may be created via Google, Apple, Email, Facebook, or Telegram. Users must provide truthful information and keep credentials secure. Creating multiple accounts, fake identities, automated signups, or attempts to bypass limitations is prohibited.

Platfone may suspend or terminate accounts for:

  • abuse or fraud
  • misuse of numbers
  • security risks
  • attempts to circumvent anti-fraud algorithms or system logic
  • regulatory or sanctions violations

Reasons for termination may be withheld to protect security systems.

5. Credits

Credits (USD-based) are consumed for activations and related services. Credits remain valid for:

  • 12 months from top-up, or
  • 6 months if no successful activations occur.

Expired Credits are forfeited and non-refundable unless required by local law.

6. Payments

Payments may be made via Stripe, Cryptomus, Payeer, Google Play, Apple iTunes, or other processors.

Some payments may be processed by TempLabs LLC (USA) strictly as a billing agent. This does not change the legal contracting party (Privatix LTD).

Crypto transactions may be delayed or rejected under AML/CTF checks. Processors may require identity verification.

7. Refunds

Refunds remain as originally defined with clarifications:

7.1 Payment Refunds
  • Card payments: refundable within 24 hours.
  • Crypto payments: refundable within 24 hours for amounts above $5.
  • Processing fees or blockchain fees may be deducted.
  • Requests must be made via [email protected].
  • For Temp-Number.org users, contact [email protected]. Refunds follow good-faith review under consumer protection laws.
7.2 Activation Refunds

Refunds for defective activations are issued only as Credits and only via the Report process.

Refunds are not granted when:

  • a third-party service (sender) fails to send an SMS
  • user selects a restricted or blocked service
  • user violates Terms of Use
  • number reuse or sender-side retry issues occur

Platfone is not responsible for third-party sender behavior. Restricted or prohibited service usage is not grounds for refund.

8. Pricing and Availability

Prices depend on supply, demand, and number quality. Displayed prices are indicative and confirmed at checkout or via API.

9. Discounts and Tiered Pricing

Automatic discounts apply by account tier. Current tiers and rates: https://platfone.com/app/prices . They may change without notice.

10. Reports and Quality Review

Platfone provides a formal process to dispute defective activations.

10.1 Time Limit to Submit Reports

A Report must be submitted within 60 minutes of activation creation. Reports submitted after this window are automatically invalid. Platfone is not responsible for third-party service behavior. Clear evidence (screenshots or video) improves outcomes.

10.2 Review Period

Platfone reviews Reports within 72 hours.

10.3 No Appeals

All Report decisions are final and cannot be appealed.

10.4 Report Abuse

Reports may not be used to obtain repeated free activations, manipulate pricing, or test sender-side services. Abuse may lead to account suspension or termination.

11. Prohibited Activities

Users may not:

  • use numbers for illegal or fraudulent activity
  • spam, scam, or impersonate others
  • violate third-party platform rules
  • commit crypto or payment fraud
  • reverse-engineer APIs or SDKs
  • use automation to bypass rate limits
  • use numbers for financial, government and other security sensitive services
  • use numbers to circumvent security procedures on services
  • circumvent, manipulate, or interfere with system procedures, algorithms, or risk-control mechanisms

Violations may lead to immediate termination without refund, including forfeiture of Credits.

12. Restricted Countries

Access is prohibited in: Russia, Belarus, Iran, Syria, North Korea, Cuba, Crimea, Donetsk, Luhansk, Zaporizhzhia, Kherson.

VPN/proxy circumvention is prohibited.

13. Open-Source License

Platfone provides open-source backend (Node.js) and frontend templates (iOS, Android, Web) under a modified MIT license. Use is allowed only when connected to Platfone API. Using other APIs voids the license. License text: https://github.com/platfone-com .

14. Partner, Retail API & White-Label Programs

Partners may use the Platform commercially.

14.1 Legal Responsibility of Partners

Partners using Retail API or White-Label solutions:

  • are legally responsible for their own end-users
  • must comply with laws of their own jurisdiction
  • must maintain their own Terms of Use and Privacy Policy
  • must not allow prohibited service usage

Platfone is not liable for Partner customer behavior or marketing practices.

15. Third-Party Trademarks

All third-party brand names, logos and service names are used for reference only. Platfone is not affiliated or endorsed by them. Trademarks remain property of respective owners.

16. Service Availability & Limitation of Liability

The Platform is provided “as is” without uptime guarantees. Temporary downtime or delays may occur.

Platfone’s total liability is limited to fees paid in the previous 12 months. We are not liable for indirect or consequential losses.

17. Product-Specific Conditions

All existing product-specific rules remain as previously defined (Dashboard, API, Retail API, White-Label, Temp-Number.org).

18. KYC / Identity Verification via Sumsub

Platfone uses Sumsub to perform identity verification.

18.1 When KYC Is Required

KYC becomes mandatory when:

  • usage thresholds for Activation, Retail, or White-Label APIs are exceeded
  • suspicious activity is detected
  • the account is manually flagged

Users may voluntarily start KYC after one successful balance top-up.

18.2 How KYC Works
  • Identity documents are uploaded directly to Sumsub.
  • Platfone receives verification results only (approved/rejected).
  • Platfone does not store document images.
18.3 Consequences of Not Completing KYC
  • new activations are blocked
  • advanced features are restricted
  • refunds are not granted on this basis

19. Account Removal & Deletion

Users may delete their account via dashboard or email request. Credits are forfeited upon deletion unless required by law.

21. Entire Agreement

These Terms form the complete agreement between you and Platfone. If any conflict exists, the Privacy Policy governs data processing matters.

This Privacy Policy explains how Platfone (operated by Privatix LTD) collects, uses, shares, and protects personal data when you use platfone.com, our APIs, dashboards, mobile apps, and related services (the “Platform”). By using the Platform, you agree to this Policy and our Terms of Use.

1) Who We Are (Controller)

Privatix LTD is the primary data controller.

For certain integrations (e.g., Retail API or White-Label), Platfone may act as a data processor under a Data Processing Addendum (DPA).

2) Scope

This Policy applies to all Platform users, including direct customers, API clients, partners, resellers, and white-label operators.

3) Data We Collect

We collect only what is necessary to operate, secure, and improve the Platform.

3.1 Account & Identity Data
  • Email, Telegram, Google, Apple, or Facebook login IDs
  • Firebase UID, display name, IP country
  • Partner or reseller profile details
3.2 Payment & Billing Data
  • Amount, currency, timestamps
  • Payment processor metadata (e.g., BIN, wallet address, issuer country)
  • Payout details for partners

Important: Platfone does not store full bank card details. All sensitive card/wallet data is handled by Stripe, Cryptomus, Payeer, PayPal, or other certified processors.

3.3 Technical & Usage Data
  • Device/browser type
  • API activity and rate limits
  • IP, region, and timestamps
  • Activation logs (service, country, time, result)
3.4 Verification Message Content

Limited SMS or call content may be stored for:

  • fraud prevention
  • support
  • quality review

Retention: 12 months or last 1,000 activations, whichever comes first.

3.5 KYC / Identity Verification Data

Platfone uses Sumsub for identity verification.

When you initiate or are required to complete KYC, the following may be processed:

  • name, date of birth, country
  • document type (passport, ID card, etc.)
  • verification metadata
  • final status: approved, rejected, pending

We do NOT store document images.

Identity documents are uploaded directly to Sumsub. Platfone receives only verification results and applicant metadata.

3.6 Cookies & SDKs

Cookies support login sessions, analytics, and performance.

4) Sources of Data

  • data you provide (registration, forms)
  • usage data collected automatically
  • payment processors, suppliers, analytics providers

6) Cookies & Tracking

We use first-party and third-party cookies for authentication, analytics, and performance. Some cookies are essential.

7) Sharing & Sub-Processors

We share personal data only with trusted vendors and authorities when legally required.

Platfone also uses Mailtrap.io as an email delivery and compliance tool for sending transactional and verification-related notifications.

8) International Transfers

Your data may be processed outside your country, including in the U.S., EU, UK, or EEA. Adequate safeguards (e.g., SCCs) are applied.

9) Retention

  • Account info: lifetime of account + 90 days
  • Payments/invoices: 7 years
  • Logs: 30–180 days
  • Activations/messages: 12 months or 1,000 last records
  • Reports/disputes: until resolution + required legal period
  • KYC audit logs: 3–6 months unless required longer by law

10) Security

We apply encryption, access control, rate-limiting, firewalls, and continuous monitoring.

11) Your Rights

Depending on jurisdiction, you may:

  • access your data
  • correct inaccuracies
  • request deletion
  • restrict processing
  • withdraw marketing consent

Requests may be restricted where fraud, AML, or legal obligations apply.

12) Children

Platfone is not intended for users under age 18.

13) White-Label & Partner Data Roles

  • For direct users: Platfone acts as data controller.
  • For Retail API / White-Label operators: Platfone acts as data processor.
  • Partners are legally responsible for the actions and compliance of their own end-users.

Platfone is not responsible for Partner customer behavior and marketing activities.

14) AML, Sanctions, Abuse & Geo-Restrictions

We enforce AML/CTF screening, sanctions restrictions, and fraud-prevention measures. Crypto transactions may be delayed or rejected.

Use from restricted regions is blocked.

15) Account Deletion

You may delete your account via dashboard or email. Some data (e.g., invoices, AML logs) may remain for legal reasons. Temp-Number.org users: Contact [email protected] for product-specific support.

16) KYC & Identity Verification

KYC may be required for:

  • high-volume usage
  • suspicious behavior
  • partner-level compliance
  • manual flagging

Platfone does not override Sumsub decisions.

If KYC is required and not completed, feature access may be restricted.

17) Sensitive Data

Sensitive data (IDs, payment metadata) is handled with encryption and limited access. Platfone does not store biometric data.

18) Database Registration

Databases may be registered with the Israeli Privacy Protection Authority (IPPA) where required.
